The terms governing your use of the HansMed Modern TCM platform.

管辖您使用汉方现代中医平台之条款。

1. Acceptance of these Terms · 接受条款

By creating an account or using the HansMed Modern TCM platform (the “Platform”), you agree to these Terms of Service. If you do not agree, please do not use the Platform.

当您注册帐户或使用汉方现代中医平台（「本平台」）即表示您同意本服务条款。若您不同意，请勿使用本平台。

2. Eligibility · 使用资格

You must be at least 18 years old (or use the Platform under the supervision of a parent or legal guardian) and capable of entering a binding agreement under Malaysian law.

您须年满18岁（或在父母／法定监护人监督下使用本平台），并具备依马来西亚法律订立具约束力协议之能力。

3. About our service · 服务说明

HansMed is a licensed Traditional Chinese Medicine (TCM) telehealth platform operating in Malaysia under the Traditional and Complementary Medicine Act 2016. Care is provided by T&CM Council-registered practitioners. HansMed provides the technology platform that connects you with practitioners and pharmacies.

汉方为依据《2016年传统及辅助医疗法》于马来西亚运营之持牌中医远程医疗平台。诊疗由传统及辅助医疗理事会注册之中医师提供。汉方提供连接您与中医师及药房之技术平台。

4. Not for emergencies · 非紧急医疗用途

The Platform is not for medical emergencies. If you experience a medical emergency, call 999 or go to the nearest hospital immediately.

本平台不适用于医疗紧急情况。如遇紧急医疗状况，请立即拨打999或前往最近之医院。

5. Your account · 您的帐户

• Provide accurate, complete information and keep it up to date.
• 提供准确、完整之资料并保持更新。
• Keep your login credentials confidential; you are responsible for activity under your account.
• 妥善保管登入凭证；您须为帐户下之活动负责。
• Notify us promptly of any unauthorised use.
• 如发现任何未经授权之使用，请即通知本公司。

6. The practitioner–patient relationship · 医患关系

Clinical decisions — diagnosis, treatment and prescriptions — are made by the licensed practitioner treating you, exercising their professional judgement. HansMed does not itself practise medicine.

临床决定 — 诊断、治疗及处方 — 由为您诊治之持牌中医师依其专业判断作出。汉方本身不从事医疗执业。

7. AI-assisted features · AI 辅助功能

The Platform offers AI-assisted tools (e.g. tongue-image analysis, intake structuring) that produce educational wellness insights for practitioner review. These are decision-support tools, not a medical diagnosis, and are always reviewed by a licensed practitioner before they inform your care. See the Patient, AI & Telemedicine Consent for details.

本平台提供 AI 辅助工具（如舌象分析、问诊整理），生成供中医师审核之教育性健康洞察。该等工具属辅助决策性质，并非医疗诊断，且于影响您之诊疗前均经持牌中医师审核。详情请参阅《患者、AI 及远程医疗同意书》。

8. Prescriptions & pharmacy fulfilment · 处方与药房配送

Prescriptions are issued at a practitioner’s discretion and are not guaranteed. Herbal orders are dispensed by the fulfilling pharmacy. Always follow the dosage and guidance provided.

处方由中医师酌情开立，并不保证一定开立。中药订单由配药药房配送。请务必遵循所提供之剂量与指引。

9. Payments & refunds · 付款与退款

Fees are shown before you confirm. Payments are processed by HitPay. Refund eligibility (e.g. for cancelled consultations) will be set out in our refund policy. [Refund terms to be finalised with legal advisor.]

费用于您确认前显示。付款由 HitPay 处理。退款资格（如取消问诊）将载于退款政策。〔退款条款待与法律顾问确定。〕

10. Acceptable use · 使用规范

• Do not misuse the Platform, attempt unauthorised access, or disrupt its operation.
• 请勿滥用本平台、尝试未经授权之存取或干扰其运作。
• Do not impersonate others or provide false health information that could affect care.
• 请勿冒充他人或提供可能影响诊疗之虚假健康资料。

11. Intellectual property · 知识产权

All Platform content, software and branding are owned by HansMed or its licensors and may not be copied or reused without permission.

本平台之所有内容、软件及品牌均属汉方或其授权人所有，未经许可不得复制或再利用。

12. Disclaimers & limitation of liability · 免责声明与责任限制

To the maximum extent permitted by Malaysian law, the Platform is provided “as is”. HansMed is not liable for outcomes of clinical judgement made by practitioners, nor for indirect or consequential loss. Nothing limits liability that cannot be limited by law. [To be reviewed by legal advisor.]

在马来西亚法律允许之最大范围内，本平台按「现状」提供。对于中医师所作临床判断之结果，以及任何间接或衍生损失，汉方概不负责。本条款不限制法律规定不可限制之责任。〔待法律顾问审核。〕

13. Privacy · 隐私

Your personal data is handled in accordance with our Privacy Policy.

本公司依据《私隐政策》处理您的个人资料。

14. Changes to these Terms · 条款变更

We may update these Terms; material changes will be notified through the Platform. Continued use after changes means acceptance.

本公司可更新本条款；重大变更将透过本平台通知。变更后继续使用即视为接受。

15. Governing law · 管辖法律

These Terms are governed by the laws of Malaysia, and disputes are subject to the jurisdiction of the Malaysian courts.

本条款受马来西亚法律管辖，争议受马来西亚法院管辖。
